This proposed class action has been brought on behalf of all individuals in Canada who, while acting for personal, family, or household purposes (i.e. not for a business purpose), paid a fee described as “DMDF”, “DMC”, “LF&T”, “Local Fee”, “Resort Fee”, “Hotel Fee” and/or “Tourism Promotion Fee” in relation to hotel accommodation located in Niagara Falls, Ontario at one or more of the following hotels (the “Hotels”):
This action alleges that the Hotels are violating consumer protection legislation by making misleading and deceptive representations regarding the fees they charge consumers in relation to stays at the Hotels. The main allegation is that the Hotels misrepresent the nature of certain fees by presenting them in a way that suggests that they are mandatory and legitimate government-imposed fees or taxes when in fact they are not.
The action seeks, among other things, to recover the fees from the Hotels for consumers.
