A proposed class proceeding has been filed on behalf of consumers who paid certain fees related to hotel stays in Niagara Falls, Ontario.

Case Details

This proposed class action has been brought on behalf of all individuals in Canada who, while acting for personal, family, or household purposes (i.e. not for a business purpose), paid a fee described as “DMDF”, “DMC”, “LF&T”, “Local Fee”, “Resort Fee”, “Hotel Fee” and/or “Tourism Promotion Fee” in relation to hotel accommodation located in Niagara Falls, Ontario at one or more of the following hotels (the “Hotels”):

  • DoubleTree Fallsview Resort & Spa - By Hilton;
  • Courtyard by Marriott Niagara Falls;
  • Wyndham Fallsview;
  • Best Western Plus Cairn Croft Hotel;
  • Comfort Inn Fallsview;
  • Country Inn & Suites by Radisson, Niagara Falls, ON; or
  • Crowne Plaza Niagara Falls - Fallsview.

This action alleges that the Hotels are violating consumer protection legislation by making misleading and deceptive representations regarding the fees they charge consumers in relation to stays at the Hotels. The main allegation is that the Hotels misrepresent the nature of certain fees by presenting them in a way that suggests that they are mandatory and legitimate government-imposed fees or taxes when in fact they are not.

The action seeks, among other things, to recover the fees from the Hotels for consumers.

  2. Who can participate in the proposed class action?

    Any individuals in Canada who paid certain fees related to stays in any of the Hotels included in the proposed class action.

  3. Do I need to do anything to join the proposed class action?

    No. The action has not yet been certified by the court. If it is certified, a person who fits within the court's definition of the class is automatically included in the class action unless he or she follows the court's instructions on how to be excluded.

  4. What should I do now?

    Keep any documents that relate to a booking, and charge, for any accommodation reservation for non-business purposes made at any of the Hotels named in the class action.
